BLACKBURN MP Jack Straw has backed Aviva in calling for whiplash claims to be taken directly to the insurer of the driver who caused the crash.
The UK’s biggest insurer said that motorists' premiums could be cut by an average of £60 each year by changing the system.
Aviva suggests this would cut out middlemen who inflate the cost of claims.
Here at Clearwater Solicitors along with many
solicitors in Blackburn do not believe the comments made by Blackburn MP Jack Straw and Aviva. They have failed to mention the real reason why premiums have increased. As for many years the insurance companies have been selling their customers details to third party companies for referral fees which has increased the number of claims and increased the average motorist’s premium. In fact many customers are not aware how their details are obtained by the claims management companies and are hounded by unwanted calls.
Clearwater Solicitors LLP also believes such a change would leave victims of a Road Traffic Accident vulnerable. The Association of Personal Injury Lawyers stated "Putting the injured person entirely in the hands of the guilty party's insurer would create a profound conflict of interest. Independent advice is key to ensuring a fair outcome for the injured person"
Clearwater Solicitors LLP strongly believes in our client’s freedom to appoint an independent solicitor. We believe this is a fundamental right which should not be restricted. Insurance companies primary duty is to their shareholders in the form of increasing profits which would conflict with their duty to pay an injured person the appropriate amount in compensation.
